Privacy Policy

Last updated: October 23, 2026

DesignSilk LLC (“DesignSilk,” “we,” “us,” or “our”) respects the privacy of people who visit our website, contact us about creative services, and work with our team. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices available to you.

This Policy covers our website at https://design-silk.com, business inquiries, communications, and information we handle in operating our creative agency. It should be read alongside our Terms and Conditions and any separate agreement with a client.

1. Who We Are & When This Policy Applies

DesignSilk LLC is a creative agency based in San Diego, California. We provide branding, creative direction, website development, product design, marketing creative, and related services.

For information collected directly from visitors, prospective clients, and our business contacts, DesignSilk generally determines how and why the information is used.

When we handle personal information solely on a client’s instructions while performing an engagement, that client may be responsible for determining the purpose and lawful basis of the processing. Our handling of that information is also governed by the applicable client agreement and any required data processing agreement.

This Policy does not replace the privacy policies of our clients or the separate privacy notices of third-party services you choose to use.

2. Information We Collect

Information You Give Us

When you complete our inquiry form, send an email, schedule a meeting, request a proposal, or engage our services, we may collect:

  • Your name and business contact details, such as email address and telephone number

  • Your company name, company website, job title, or other professional information

  • Information about your project, business goals, timelines, and approximate budget

  • Messages, attachments, and other information you choose to share

  • Scheduling information, meeting notes, and, where permitted, meeting transcripts or summaries

  • Billing contacts, invoice details, payment status, and other transaction records

You can choose not to provide information that is optional. Some details may be necessary for us to respond to your request or perform an agreed service.

Client Project Information

During an engagement, clients may provide branding assets, documents, research, product plans, website content, design files, account access, feedback, or other project materials. Some of these materials may contain personal information.

We use those materials to deliver the agreed services, maintain project records, communicate with authorized collaborators, and meet applicable legal obligations.

Website & Technical Information

When you visit our website, our hosting and service providers may process technical information needed to deliver, secure, and measure the site. Depending on the tools in use, this may include IP address, browser and device information, referring pages, pages visited, approximate location derived from network information, and website performance or interaction data.

Our website is built using Framer. Framer’s native analytics may provide aggregated information about site traffic and performance. Additional tools or embedded services, if enabled, may collect information under their own privacy notices.

Information From Other Sources

We may receive business contact information from referrals, public professional profiles, professional directories, networking events, or a colleague at your organization. We use this information for legitimate business communications and to respond to relevant inquiries.

3. How We Use Information

We use personal information when reasonably necessary to:

  • Respond to inquiries, arrange consultations, and prepare proposals

  • Provide creative services, manage projects, and deliver agreed work

  • Communicate about schedules, requests, feedback, and approvals

  • Issue invoices, process and reconcile payments, and maintain business records

  • Operate, protect, troubleshoot, and improve our website and internal systems

  • Understand website performance and the effectiveness of our outreach

  • Maintain professional relationships and share relevant business updates, subject to applicable marketing rules

  • Protect our rights, prevent misuse, resolve disputes, and comply with legal obligations

We do not use client project files for unrelated marketing campaigns or publish confidential materials without authorization.

4. Client Confidentiality & Project Materials

We treat nonpublic client materials as confidential when they are identified as confidential or should reasonably be understood to be confidential.

Access is limited to personnel, collaborators, and service providers who need the information for an authorized business purpose, subject to appropriate confidentiality expectations and contractual protections.

We may use shared project management systems, cloud document storage, design platforms, email, and other collaborative services to complete work. The particular tools and any additional security requirements may be specified in the client agreement.

Clients should avoid sending protected health information, financial account credentials, government identification numbers, or other specially protected information until we have agreed on the necessary safeguards.

Where an engagement requires handling protected health information subject to HIPAA, applicable business associate agreements and security requirements must be established before that information is provided.

5. AI-Assisted Creative Work

We use AI-assisted tools to support activities such as research, ideation, content development, visual exploration, production, and workflow automation. Human creative judgment and review remain part of our process.

When we use AI tools or other external processors with client materials, we aim to minimize the information provided and select appropriate privacy settings and access controls.

We do not intentionally authorize confidential client information to be used to train general-purpose AI models without prior written authorization. Where available, we use provider controls designed to restrict model training on submitted materials.

Some AI providers may process or retain information according to their applicable terms, settings, and service agreements. Specific restrictions, including restrictions on particular providers or categories of data, may be established in a separate client agreement.

We do not knowingly submit specially protected or regulated client information to AI services without first establishing the necessary permissions and safeguards.

6. When We Share Information

We share information only as reasonably necessary for the purposes described in this Policy, including with:

  • Website hosting, form processing, and analytics providers

  • Business email, calendar, meeting, and scheduling providers

  • Project management, file storage, design, and collaboration platforms

  • Payment processors and financial service providers

  • AI, automation, and production service providers used for authorized work

  • Contractors and professional advisers supporting our operations under appropriate confidentiality obligations

  • Authorities or other parties when disclosure is required by law, necessary to protect rights or security, or part of a lawful business transaction

Providers used in our operations may include Framer, Google Workspace, Cal.com, Asana, Figma, Mercury, and selected AI platforms. The providers involved in a particular engagement can vary.

We do not sell contact form submissions or confidential client files to data brokers, and we do not use submitted client project materials for third-party targeted advertising.

If our practices change in a way that constitutes a sale or sharing of personal information under an applicable privacy law, we will update our disclosures and provide the required choices.

7. Payments & Financial Records

Payments may be handled by Mercury or another authorized payment provider. The provider may collect and process payment credentials, account information, and transaction data under its own terms and privacy policy.

DesignSilk may receive invoices, billing contact information, payment confirmations, payment status, and records required for accounting, contract administration, or tax compliance.

Payment card and banking information should be provided through approved payment methods rather than sent in ordinary email or project messages.

8. Cookies, Analytics & Embedded Services

Our website may use necessary technical functions and privacy-conscious traffic measurement to operate and improve the site.

Framer’s built-in analytics is designed to measure site activity without requiring the same visitor-tracking cookies used by some third-party analytics tools. The actual cookies and data processing that occur may change if we add integrations, embedded scheduling, videos, advertising pixels, or other third-party features.

Third-party services, including embedded booking tools such as Cal.com, may use cookies or similar technologies subject to their own policies.

You can manage cookies using your browser settings. Where applicable law requires consent or opt-out choices for nonessential tracking, we will provide the required mechanism before using those technologies.

We do not treat a website visit alone as consent to optional marketing cookies where affirmative consent is legally required.

9. Email & Business Communications

We may email or otherwise contact you to respond to an inquiry, discuss a proposal, provide project updates, schedule meetings, send invoices, or manage our business relationship.

We may also contact business prospects about relevant services where permitted by law.

You can opt out of optional marketing messages by using an unsubscribe mechanism when provided or by contacting us at support@design-silk.com. Opting out of marketing does not prevent essential service, transactional, or legal communications.

10. How Long We Keep Information

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, subject to applicable legal requirements.

The retention period or criteria depend on the type of information:

  • Inquiry and business contact information: the time reasonably needed to respond, evaluate a potential engagement, maintain the relationship, and manage relevant follow-up

  • Client project materials and communications: the duration of the engagement and a reasonable period afterward for delivery, support, records, dispute resolution, or applicable contractual obligations

  • Invoices and financial records: the period required for accounting, tax, regulatory, and other legal obligations

  • Website and technical information: the retention periods established by the relevant platform or service provider, limited where we control the settings

  • Meeting notes and transcripts: as reasonably needed for project coordination, documentation, and follow-up, subject to applicable consent requirements and agreed client restrictions

We may retain limited information for longer where necessary to comply with law, establish or defend legal claims, prevent abuse, or honor contractual obligations. We may also delete information sooner when it is no longer needed.

Where a client agreement requires particular return, deletion, or retention practices, that agreement takes precedence for the affected client information.

11. Security & Access Controls

We use reasonable administrative, technical, and organizational measures appropriate to the information we handle, including access controls, confidentiality requirements, and reputable third-party services.

No website, electronic transmission, or storage system can be guaranteed completely secure. We cannot promise absolute security.

If we discover a security incident involving personal information, we will investigate and provide any notifications required by applicable law and our contractual commitments.

Please do not send passwords, payment card numbers, or especially sensitive information through ordinary contact forms or email unless we have arranged a suitable secure process.

12. Privacy Rights & Requests

Depending on your location and applicable law, you may have the right to request access to the personal information we hold about you, obtain a copy, correct inaccuracies, request deletion, object to or restrict certain processing, or withdraw consent where consent is the legal basis.

You may also have rights related to portability, marketing communications, and automated processing.

To submit a privacy request, email support@design-silk.com with the subject “Privacy Request.” We may need to verify your identity or authority before completing a request, and some information may be exempt from deletion or disclosure under law.

We will respond within the time limits required by applicable law. We will not unlawfully discriminate against you for exercising your privacy rights.

Where DesignSilk handles personal information only on a client’s behalf, we may direct your request to that client or assist the client in responding.

California Privacy Rights

California residents may have rights to know, access, correct, or delete personal information and, where applicable, to opt out of sale or sharing for cross-context behavioral advertising, limit certain uses of sensitive personal information, and receive equal treatment for exercising their rights.

These rights and related obligations apply to the extent that the California Consumer Privacy Act and other applicable California laws cover our activities.

You can contact us through the privacy request process above. Where legally required, we will also recognize applicable opt-out preference signals and provide appropriate methods for authorized agents to submit requests.

Visitors Outside the United States

Where the GDPR, UK GDPR, or another privacy law applies, we process personal information on an appropriate legal basis, which may include taking steps requested before entering a contract, performing a contract, complying with legal obligations, pursuing legitimate business interests where permitted, or consent when required.

If you are entitled to do so, you may also contact your local data protection authority about how your information is handled.

13. International Processing

DesignSilk is based in the United States. Some third-party service providers and collaborators may process information in other states or countries.

Where applicable law requires safeguards for international transfers, we will use appropriate contractual or other legally recognized protections.

14. Children’s Privacy

Our website and services are intended for business audiences and are not directed to children.

We do not knowingly solicit personal information from children under 16 through our website. If you believe a child has provided personal information to us, contact support@design-silk.com so we can review the situation and take appropriate action.

15. External Links & Third-Party Services

Our website or communications may link to sites, booking platforms, social networks, or applications operated by third parties.

Those third parties control their own privacy practices. We encourage you to review their privacy notices before submitting information directly to them.

This Policy does not govern independent third-party websites or services that are outside DesignSilk’s control.

16. Updates to This Policy

We may revise this Policy when our services, tools, business practices, or legal obligations change.

We will publish the updated version with a new “Last updated” date. If a change materially affects how we handle personal information, we will provide any additional notice or choices required by law.
